My thesis is basically an exploration of the changing dynamics and complex attributes of internal armed conflicts that continue to beset postcolonial Africa and the perceived inability of international law to adequately confront them. The thesis attempts to reconceptualise the traditionally narrow international law's approach to intrastate conflicts. Its seeks to do so by examining the window of opportunity ushered in by the Constitutive Act of the African Union and its related institutional and normative frameworks. The objective is to help articulate a refreshened approach to the understanding and management of internal conflicts beyond the existing dualist conception of jus ad bellum and jus in bello.
